Terms of Service

1. Definitions
In this Agreement: "Gnost," "we," "us," and "our" refer to the Gnost brand and the sole developer operating under it. "Services" refers to all custom Discord app development, hosting, and maintenance provided by Gnost. "Client," "you," and "your" refer to any individual or entity that places an order or uses the Services. "App" refers to any custom Discord app developed, hosted, or maintained by Gnost for the Client. "Agreement" refers to these Terms of Service in their entirety.
2. The service
Gnost is a solo freelance operation providing custom Discord app development, hosting, and maintenance. All apps are developed and managed by a single developer operating under the Gnost brand. Gnost reserves the right to decline any order at its sole discretion, with or without reason.
3. Content restrictions
Gnost does not develop apps for NSFW (Not Safe For Work) content or gambling systems involving real money. Gambling or game systems using virtual currency that cannot be exchanged for real money are acceptable. Orders involving prohibited content will be declined.
4. Orders and scope
Orders are placed by configuring modules on the Gnost website, exporting a configuration file, and submitting it via the ticketing system in the official Discord server. The scope of each order is defined during the intake process and confirmed before development begins. Any features not explicitly included in the confirmed scope are not covered and will be treated as new additions, quoted separately. Gnost's failure to enforce any provision of this Agreement shall not be considered a waiver of that provision.
5. Payment and monthly fees
Every order covers a one-time build cost plus a chosen hosting period. Hosting and maintenance fees are charged on a recurring basis, they are not a subscription, but a separate upfront payment per billing period (1, 3, 6, 9, or 12 months). Fees cover hosting, uptime, bug fixes, and minor tweaks. They do not cover new features or major changes. Full details on payment structure, billing intervals, and missed payments are on the Terms & Pricing page. All payments are non-refundable except as outlined in Section 8.
6. Intellectual property and licence
All code written by Gnost remains the sole intellectual property of Gnost. Upon full payment, the Client receives a non-exclusive, non-transferable, revocable licence to use a hosted, running instance of their App, not the underlying source code. The Client may not decompile, reverse-engineer, or reproduce the App's code; sell, sublicense, or transfer access to any third party; or claim ownership or authorship of the App. Source code may be purchased separately at a cost equal to the cumulative total paid for the App up to the date of request.
6a. Watermark and attribution
All apps include an attribution watermark in the app's bio by default. This remains in place unless Gnost explicitly agrees to removal in writing. Removal may be subject to an additional fee and is at Gnost's sole discretion. Clients who own their Discord application are bound by this policy and may not remove the watermark without prior written approval.
6b. Client-owned bot applications
Where the Client creates and owns the Discord application, Gnost requires only the app token to operate the hosted instance. The Client assumes full responsibility for the security of the application, including disruptions caused by token rotation, revocation, or loss of Developer Portal access. Downtime from such events is not covered under the maintenance policy and does not pause or affect billing. Gnost will never delete a Client-owned Discord application under any circumstances; if the Client wishes the application to be deleted, they must initiate the deletion themselves via the Developer Portal.
7. Support and maintenance
Active plan holders are entitled to bug fixes and minor tweaks (value adjustments, renaming, small behavioural changes) at no additional cost. The following are not covered and require a separate quote: new commands or features, major changes to existing functionality, and anything outside the original agreed scope. If you are unsure whether a request qualifies as a minor tweak, ask before assuming.
8. Upgrades and custom additions
New modules can be added to an existing app at any time and are priced individually. Custom features beyond the pre-defined modules are treated as custom additions, scoped, agreed upon in writing, and priced before any development begins.
9. Refunds
Before development begins: a full refund of the upfront payment will be issued on request. After development begins: the upfront payment is non-refundable as it covers work already completed. After delivery: no refunds are available once the App has been deployed. If a delivered App has a genuine issue within the agreed scope, it will be resolved at no additional cost under the maintenance policy.
10. Inactive orders and ghosting
If a Client becomes unresponsive during an active order, a follow-up will be sent after 3 days, the order will be paused after 7 days, and the order will be cancelled with the upfront payment forfeited after 14 days. If you need to pause for any reason, communicate this upfront.
11. App names and characters
App names must contain only standard ASCII characters. Emoji, symbols, and special characters in app names are not supported. Gnost reserves the right to sanitise app names that don't meet this requirement. Clients must be aware that renaming their app may affect how it is internally referenced.
12. Multi-server apps
Apps support a maximum of 2 servers by default. Data is server-specific, economy balances, shop items, levels, and all other module data are isolated per server and not shared across servers. Additional servers may be added at an extra cost.
12a. Server whitelist
Every app ships with a server whitelist. The app will only operate inside server IDs explicitly approved by the Client and Gnost. If the app is added to any server outside this list, it will not respond to commands and will leave automatically. This is a security measure to prevent unauthorised redistribution of the app and to protect the integrity of the Client's deployment. Whitelist changes (adding or removing server IDs) are handled via ticket and may be subject to additional cost depending on plan tier.
13. Server and ownership transfers
Server transfers may be requested by submitting the current and replacement server IDs via ticket, subject to the developer's discretion. Ownership transfers are free. Both the current and incoming owner must confirm the transfer in the same ticket thread. Gnost reserves the right to decline transfers where the incoming party cannot be verified or where outstanding fees remain unpaid.
14. Archiving and cancellation
You may archive your app at any time through the /myinfo command in the gnost Discord server. Remaining plan time is frozen upon archival, the billing clock pauses and resumes on reactivation. No refund is issued for frozen time. If your app remains archived for 12 months without reactivation, a deletion notice will be issued with a 30-day window to reactivate before permanent deletion. Apps with outstanding fees may not be restored. Following permanent deletion, a lightweight showcase profile, comprising the app's name, description, feature list, and any screenshots previously added to the portfolio, may be retained on the gnost website for portfolio purposes. This does not constitute retention of personal data.
15. Client responsibilities
The Client is solely responsible for ensuring their server and use of the App complies with Discord's Terms of Service and Community Guidelines; providing accurate information during intake; not using the App for unlawful, abusive, or harmful purposes; and the conduct of all members within their server in relation to the App. Gnost has no control over and no affiliation with the Discord servers or communities that use the Services. If a App is found to be used in violation of Discord's Terms of Service or any applicable law, hosting may be terminated immediately without refund.
16. Indemnification
The Client agrees to defend, indemnify, and hold harmless Gnost from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable legal fees, arising out of or relating to the Client's use of the Services, violation of this Agreement, or any actions taken by the Client or their server members in connection with the App.
17. Limitation of liability
Gnost provides the Services on an as-is basis. While reasonable efforts are made to ensure reliability and uptime, no guarantees are made regarding uninterrupted or error-free service. Under no circumstances shall Gnost be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the Services, including data loss, server disruptions, or loss of revenue.
18. Service termination
Gnost reserves the right to suspend or terminate the Services at any time, with or without prior notice, in the event of a breach of this Agreement, use of the App in violation of Discord's Terms of Service or applicable law, or any conduct reasonably determined to be harmful to the integrity of the Services. Upon termination, the Client's licence to use the App is immediately revoked.
19. Severability
If any provision of this Agreement is found to be unenforceable or invalid, it will be modified to the minimum extent necessary to make it enforceable, or removed if modification is not possible. The remaining provisions continue in full force and effect.
20. Entire agreement
This Agreement, together with the Terms & Pricing page and Privacy Policy, constitutes the entire agreement between Gnost and the Client regarding the Services, and supersedes all prior understandings, whether written or oral.
21. Changes to these terms
These terms may be updated at any time. Continued use of the Services following any update constitutes acceptance of the revised terms. Significant changes will be announced in the Discord server.
